To fully implement the spirit of the 19th CPC National Congress, promote Guangdong, Hong Kong and Macau The national strategy of the Greater Bay Area is to implement General Secretary Xi Jinping’s work on Shenzhen’s "Grasp the major opportunities in the construction of the Guangdong-Hong Kong-Macao Greater Bay Area and enhance the core engine functions". In accordance with the instructions of Shenzhen Municipal Party Committee Secretary Wang Weizhong on "further strengthening international cooperation and building an international arbitration highland", the Shenzhen Court of International Arbitration (also known as "South China International Economic and Trade Arbitration Commission" and "Shenzhen Arbitration Commission", English SCIA) gives full play to the special advantages of cross-border jurisdiction and cross-border enforcement of international arbitration. Under the background of "one country, two systems, three jurisdictions", promote the mutual recognition, symbiosis, integration and convergence of the three systems, mechanisms and rules, and continue to strengthen The core engine function actively promotes the construction of the Guangdong-Hong Kong-Macao Greater Bay Area and introduces ten major measures:

1. Further strengthen Hong Kong and Macau in the corporate governance mechanism factor. As the world’s first arbitration institution to implement a statutory institution management model, it will further increase the proportion of Hong Kong and Macau directors, give full play to the decision-making and supervisory role of Hong Kong and Macau celebrities in the Shenzhen Court of International Arbitration, and promote Guangdong, Hong Kong and Macau commercial arbitration consultations, Co-construction, co-governance and sharing.

Interpretation: November 2012 , The Shenzhen Municipal Government issued government regulations "Shenzhen Court of International Arbitration Management Regulations (for Trial Implementation)" (Shenzhen People’s Government Order No. 245), clarifying the Shenzhen Court of International Arbitration (SCIA) as a legal person with a board of directors in the form of special zone legislation Governance mechanism. SCIA has become the world's first arbitration institution operating in accordance with special legislation, and it is also the only arbitration institution in China that implements statutory agency management. According to legislative requirements, no less than one-third of SCIA directors are from Hong Kong and overseas. Of the 13 current members of the second council, six are from Hong Kong, including Hong Kong’s well-known legal person Liang Aishi (the deputy director of the Hong Kong Basic Law Committee of the Standing Committee of the National People’s Congress, and the first secretary of the Department of Justice of the Hong Kong Special Administrative Region Government), Liang Dingbang (Hong Kong Senior Counsel, former chairman of the Hong Kong Securities Regulatory Commission, former chief consultant of the China Securities Regulatory Commission), Wang Guiyi (former chairman of the Hong Kong Law Society, chairman of the Pacific Rim Bar Association, former chairman of the Hong Kong International Arbitration Center), Peter Malanczuk (an internationally renowned arbitration expert, Hong Kong University professor, former dean of the Faculty of Law of the University of Rotterdam in the Netherlands), as well as the newly recruited Yuan Guoqiang (the former director of the Hong Kong Department of Justice) and Liu Chunhua (the head of the Legal Department of the Liaison Office of the Central People’s Government in the Hong Kong Special Administrative Region) in 2018. Among them, Mr. Liang Dingbang was hired as the vice chairman of SCIA, which is the first time that a Hong Kong citizen has been appointed as the vice chairman. SCIA's international corporate governance mechanism ensures the authority of decision-making and international credibility. SCIA intends to further optimize the operation mechanism of the board of directors, to better play the role of Hong Kong and Macau directors in the decision-making and supervision of the board of directors, and to absorb and learn from the advanced institutional governance models of Hong Kong and Macau. With experience, we will jointly build and govern an international arbitration institution that meets the needs of the Guangdong, Hong Kong and Macao markets.

2. Continue to increase the number of Hong Kong and Macau arbitrators. Combined with the needs of international arbitration cooperation in the Guangdong-Hong Kong-Macao Greater Bay Area and the construction of an international business environment, we will continue to increase the number of Hong Kong and Macau arbitrators, give full play to the professional advantages of Hong Kong and Macau arbitrators in their respective jurisdictions, and jointly build an international arbitration highland in the Greater Bay Area .

Interpretation: At the beginning, as the first international arbitration institution in Guangdong, Hong Kong and Macau, SCIA established a good cooperative relationship with the Hong Kong legal profession. In 1984, 8 of the first 15 arbitrators were from Hong Kong, including Hong Kong lawyers such as Ruan Beiyao and Liao Yaozhu. In the latest roster of arbitrators announced by SCIA on December 23, 2018 and activated on February 21, 2019, there are 147 arbitrators from Hong Kong and Macau, including former Secretary of Justice of Hong Kong, Leung Ai-shi, Huang Renlong, Yuan Guoqiang, etc. Well-known figures in the legal and economic circles of Hong Kong and Macao accounted for more than 15%, far exceeding other domestic arbitration institutions. SCIA is also the arbitration institution that employs the most Hong Kong arbitrators in the world. This is conducive to taking advantage of the professional advantages of Hong Kong and Macau arbitrators in different jurisdictions, thereby improving the international level of SCIA arbitration and enhancing the overall credibility of arbitration in the Greater Bay Area. Hong Kong and Macao arbitrators have played an active role in the development of the SAR's international arbitration, and have played a key role in the credibility of the SAR's international arbitration in Hong Kong and Macao. Among the arbitration cases accepted by SCIA, the number of cases involving Hong Kong parties ranks first in foreign-related cases. Among the arbitration enforcement cases accepted by Hong Kong courts, SCIA has also ranked first for many years, with a support rate of 100%, reflecting the Shenzhen quality of international arbitration. . In the next step, SCIA will learn from international practices, fully stimulate the enthusiasm of Hong Kong and Macau arbitrators, and inject new vitality into the innovative and integrated development of international arbitration in the Greater Bay Area.

3. Promote system integration through innovation of rules. Increase rule innovation, actively promote the application of Shenzhen International Arbitration Rules with Hong Kong as the default place of arbitration in the Greater Bay Area, encourage Chinese and foreign parties to apply Hong Kong law, and further promote the convergence of arbitration systems.

Interpretation: In order to give full play to The advantages of Hong Kong cooperation. With the support of the Supreme People’s Court, SCIA has been the first in China to formulate the "Procedural Guidelines on the Application of the "United Nations Commission on International Trade Law" Arbitration Rules" through full communication with the Hong Kong Department of Justice and other relevant departments. Provisions: “If the parties have not agreed on the place of arbitration, the place of arbitration shall be Hong Kong, unless the arbitration tribunal decides otherwise. "This provision regards Hong Kong as the default place of arbitration, promotes the default application of Hong Kong law in relevant international arbitration cases, and establishes a diversified dispute resolution mechanism that includes consultation, joint construction, and sharing. This rule innovation has attracted great attention from the international arbitration community. It not only strongly supports Hong Kong's establishment of an international legal and dispute resolution service center in the Asia-Pacific region in accordance with the national “13th Five-Year Plan” plan and the Guangdong-Hong Kong-Macao Greater Bay Area plan. More Hong Kong professionals will participate in Shenzhen's international arbitration business in the role of arbitrators, agents or expert witnesses, share the opportunities of the mainland legal service market, and face the world together to build an international dispute resolution highland. In the next step, SCIA will work with relevant agencies to vigorously promote this rule arrangement in the Greater Bay Area and increase the integration of the three places in terms of case handling procedures.

4. Give full play to joint advantages and improve cooperation level. Further play to the brand advantage of “South China National Association”, tap the experience of the Guangdong-Hong Kong-Macao Arbitration and Mediation Alliance over the past five years since its establishment, integrate the resources of the alliance’s 15 major arbitration and mediation institutions, innovate cooperation methods, and optimize cooperation mechanisms. Formulate unified business rules and give play to the core, leading and radiating role of the Guangdong-Hong Kong-Macao Greater Bay Area mediation and arbitration cooperation platform to effectively, harmoniously and efficiently resolve cross-border commercial disputes.

Interpretation: As early as 2010 In accordance with the unified deployment of the Shenzhen Municipal Party Committee and Municipal Government, SCIA has carried out Guangdong-Hong Kong-Macao arbitration and mediation cooperation, which is in line with the "Guangdong-Hong Kong-Macao Greater Bay Area Development Plan" proposed by "supporting the exchanges and cooperation of Guangdong-Hong Kong-Macao arbitration and mediation institutions, and for the economic and trade of Guangdong-Hong Kong-Macao" Provide arbitration and mediation services. "SCIA actively develops Guangdong-Hong Kong-Macao international arbitration and mediation cooperation. In 2013, it took the lead in establishing the Guangdong-Hong Kong-Macao Arbitration and Mediation Alliance (formerly known as the "Guangdong-Hong Kong-Macao Commercial Mediation Alliance") to integrate commercial arbitration mediation resources in Guangdong, Hong Kong and Macau, and strengthen commercial arbitration and mediation. Business exchanges and cooperation between mediation service agencies provide professional, efficient and harmonious dispute resolution services for parties including Guangdong, Hong Kong and Macao. The member institutions of the alliance include 15 major commercial mediation and arbitration institutions in the Guangdong-Hong Kong-Macao Greater Bay Area from Guangdong, Hong Kong, and Macau, including 7 in Guangdong, 7 in Hong Kong, and 1 in Macau, which have extensive representation and influence. The alliance has established an equal and open cooperation mechanism, with Guangdong, Hong Kong and Macao taking turns to assume the chairmanship.

Over five years since its establishment, the alliance has organically integrated the diversification of Guangdong, Hong Kong and Macao Dispute resolution resources, continue to strengthen the close communication and cooperation between legal service agencies and professionals in the Greater Bay Area, actively serve the country's "One Belt One Road" and the construction of the Guangdong-Hong Kong-Macao Greater Bay Area, and resolve a large number of cross-border commercial disputes through alliance cooperation mechanisms , There are 118 countries of origin for arbitration and mediation parties. Recently, the alliance will also release new dispute resolution rules, further emphasizing the cooperation and integration of commercial dispute resolution mechanisms and institutions in the three places, helping the Greater Bay Area market to further improve the level of interconnection and efficient and convenient flow of production factors. By optimizing the operating mechanism of the cooperation platform, the Guangdong-Hong Kong-Macao Greater Bay Area mediation and arbitration cooperation platform will play its core, leading and radiating role to promote the complementary advantages of Guangdong-Hong Kong-Macao international arbitration and mediation and achieve common development.

5. Promote Guangdong-Hong Kong-Macao linkage and common services&ldquo ;One Belt One Road”. Based in Shenzhen, strengthen Hong Kong and Macao factors in cooperation mechanisms such as Sino-African Joint Arbitration, Sino-US Joint Arbitration, and Sino-European Joint Arbitration, and give full play to the advantages of Hong Kong's radiation of common law countries and Macao's radiation of Portuguese-speaking countries, and increase overseas The layout of the trial center serves the construction of the "Belt and Road Initiative".

As a pioneer city in China's opening up, Shenzhen has made solid steps to explore the creation of a world-class business environment. The exploration and practice of the establishment of the North American Trial Center is of great significance. It marks the deepening of China's international arbitration "going out" strategy, and the participation of "Chinese rules" in international competition at a higher level. It also marks that Chinese arbitration institutions have moved from Shenzhen Really go to the world and show China's "system self-confidence"quo;, work hard to contribute to “Chinese wisdom and Chinese solutions”. This move is highly compatible with the central government’s opening-up spirit, the “One Belt, One Road” initiative, and the “Guangdong-Hong Kong-Macao Greater Bay Area” construction needs. It will play an important role in creating a world-class business environment in the Greater Bay Area and building an international arbitration highland. effect.
