The Hong Kong Chinese Enterprises Association (hereinafter referred to as the "China Enterprise Association"), in accordance with the purpose of "encouraging and assisting members to deal with commercial disputes by means of reconciliation" established by the organization outline, responds to the Hong Kong Special Administrative Region Government's call for "mediation first" in commercial disputes , The establishment of a commercial mediation committee (hereinafter referred to as "mediation committee"). The Mediation Committee follows the principles of voluntariness, independence, objectivity, fairness, impartiality, and confidentiality, and resolves commercial disputes encountered by Chinese-funded enterprises in Hong Kong through mediation in a harmonious, fast, effective, and low-cost manner, and promotes the healthy development of economy and trade.
In order for the settlement agreement to be effectively implemented, the parties can choose a combination of mediation and arbitration, that is, the South China International Economic and Trade Arbitration Commission (Shenzhen Court of International Arbitration) will make a settlement award based on the mediation agreement, so that the settlement agreement reached by the parties through mediation has Finality and enforceability.
Relying on the advantages of Hong Kong's legal environment and professional talents, the mediation committee hires senior legal personnel from Hong Kong Chinese-funded enterprises, senior arbitrators from the Mainland, and senior independent professionals from Hong Kong as mediators. It also establishes an advisory committee and invites well-known business and legal professionals to serve as consultants. Provide guidance for the business development of the mediation committee.
